Article 2 — Purpose and scope
These Terms and Conditions of Sale (hereinafter the “Terms”) set out the conditions under which the Seller offers digital photographs for sale through the Site.
Fraamed is a platform specialising in sports photography, particularly surf photography, allowing users to find, view and buy photographs taken during sports sessions.
These Terms apply to any order placed on the Site by a consumer, meaning an individual acting for purposes outside their trade, business, craft, profession or farming activity.
Placing an order implies acceptance of these Terms, which the Customer acknowledges having read before proceeding to payment.
The Seller reserves the right to amend these Terms. The version applicable to an order is the one in force on the date the order is confirmed.
Article 3 — Description of products
The products offered for sale are digital photographs showing, in particular, surfers and other athletes practising their sport.
The photographs are presented on the Site as previews that may carry a watermark intended to protect the pictures against unauthorised use.
Unless otherwise stated on the product page, the purchase relates solely to the supply of a digital file. No paper print, frame or other physical medium is included.
Each photograph is accompanied, on the Site or during the ordering process, by the essential information the Customer needs to know the characteristics of the file supplied.
Depending on the product, this information includes the file format, its resolution, its dimensions and any restrictions on use.
Purchased photographs are delivered in JPEG format, at the original resolution of the file supplied by the photographer, without a watermark.
The photographs shown on the Site may vary in framing, brightness, colours or aesthetic characteristics.
Colour rendering may also vary depending on the screen and display settings used by the Customer.
Photographs may be offered individually or in bundles, depending on the offers available on the Site.
Article 4 — Access to the service
The Fraamed catalogue can be browsed without creating a user account.
The Customer can make a purchase without having to create an account.
To confirm their order, they must in particular provide a valid email address to which information about their purchase can be sent.
The Customer is responsible for the accuracy of the information provided when ordering.
Fraamed cannot be held responsible for delivery problems resulting from an incorrect email address provided by the Customer, without prejudice to its legal obligations. The Customer may contact customer service to request a correction or for the files to be made available again.
The Site is intended to be accessible at all times, subject to maintenance, technical incidents and events beyond the Seller’s control.
Article 5 — Prices
Photograph prices are shown in euros (€), including all taxes, at the VAT rate applicable to the order.
The applicable price is the one displayed when the order is confirmed.
Fraamed reserves the right to change its prices at any time. Such changes do not apply to orders already confirmed.
Any promotions or special offers apply under the conditions and during the periods stated on the Site.
Before finally confirming the order, the Customer is shown a summary of the selected products and the total amount payable, including taxes and any additional charges.
No additional charge may be made without informing the Customer beforehand and, where required by the regulations, without their express agreement.
Article 6 — Ordering process
To place an order on Fraamed, the Customer follows these steps:
- They browse the catalogue and select one or more photographs.
- They add the photographs they want to their basket.
- They go to their order summary.
- They check the selected products, their essential characteristics and the total amount payable.
- They provide the information needed for their order, in particular their email address.
- They read and accept these Terms.
- They pay securely for their order.
Before final confirmation, the Customer must be able to check the details of their order and correct any errors.
The final confirmation button clearly indicates that the order involves an obligation to pay.
The order becomes binding once the Customer has confirmed it and the payment has been accepted, subject to the legal provisions on withdrawal and guarantees.
An order confirmation is sent to the email address provided by the Customer.
This confirmation sets out the main contractual information and the legally required details on a durable medium.
The Seller keeps information about the order under the conditions laid down by the applicable regulations.
Article 7 — Payment
Orders are paid for online through the secure payment provider Stripe.
The payment methods available are those offered to the Customer at the time of ordering.
Payment is made in euros.
The bank details needed for the transaction are processed by Stripe as part of its secure payment service.
Fraamed does not intend to keep Customers’ full card numbers.
Confirmation of the order is subject to the payment being accepted.
If payment is refused or fails, the order cannot be considered paid and the corresponding photographs are not made available for that payment attempt.
If a payment is debited but the files are not actually made available, the Customer may contact Fraamed so that the transaction can be checked and a suitable solution provided.
Article 8 — Delivery and download of photographs
Purchased photographs are supplied exclusively as digital files.
No postal dispatch or physical delivery is provided for under these Terms.
Once payment has been confirmed, the files are made available to the Customer as indicated during the ordering process.
The files can be downloaded from the confirmation page shown on the Site after payment; the download link is also sent by email.
The files are made available immediately after the payment is confirmed.
The Customer is informed of this timeframe before confirming their order.
Downloading requires an internet connection and a device and software compatible with the format of the file supplied.
The Customer is advised to download and save the purchased files on a personal storage medium.
The files can be downloaded as many times as needed for 30 days from payment.
If a download fails, a file is corrupted, a link is invalid or a purchased photograph cannot be accessed, the Customer may contact customer service at contact@fraamed.com.
Fraamed will carry out the necessary checks and, depending on the circumstances, offer to make the file available again, bring it into conformity or provide any other solution provided for by the applicable regulations.
Any time limits on access to download links do not affect the Customer’s statutory guarantees.
Article 9 — Right of withdrawal
9.1. General principle
In accordance with Article L.221-18 of the French Consumer Code, the consumer Customer has, in principle, fourteen (14) days to exercise their right of withdrawal from the conclusion of a contract for the supply of digital content not supplied on a tangible medium.
They may exercise this right without giving any reason, under the conditions laid down by the regulations.
9.2. Exception for digital content
The photographs sold on Fraamed are supplied as digital content not on a tangible medium.
In accordance with Article L.221-28, 13° of the French Consumer Code, the right of withdrawal can no longer be exercised once the supply of the digital content has begun before the end of the fourteen-day period, provided that the following legal conditions are met:
- The Customer has given their prior express consent for the supply of the digital content to begin before the end of the withdrawal period.
- The Customer has expressly acknowledged that they would lose their right of withdrawal as a result of this early start.
- The Seller has provided them with confirmation of this consent and acknowledgement, under the conditions laid down by law, on a durable medium.
These formalities must actually be complied with during the purchasing process.
Where the legal conditions for the exception are met, the Customer no longer has a right of withdrawal for the digital content whose supply has begun.
Otherwise, the right of withdrawal remains applicable under the legal conditions.
9.3. How to exercise the right of withdrawal
Where the Customer is entitled to withdraw, they may notify Fraamed of their decision:
- By email: contact@fraamed.com
- By post: Redmoot — Fraamed, 33 avenue de l’Aquitaine, 64100 Bayonne, France.
They may use the model form in the annex to these Terms or any unambiguous statement setting out their decision to withdraw.
Where the right of withdrawal applies, the Customer may also use the online withdrawal function provided on the Site in accordance with the regulations in force.
The Seller acknowledges receipt of the request under the conditions laid down by law.
9.4. Refund following a valid withdrawal
Where a Customer validly exercises their right of withdrawal, Fraamed refunds the sums due within fourteen (14) days at most from the date on which it is informed of the decision to withdraw.
The refund is made using the same payment method as the one used for the order, unless the Customer expressly agrees otherwise and provided this incurs no cost for them.
9.5. Statutory guarantees remain
Any loss of the right of withdrawal does not deprive the Customer of their rights under the statutory guarantee of conformity or other applicable mandatory provisions.
Article 10 — Complaints, refunds and cancellations
Any problem with an order may be reported to Fraamed at: contact@fraamed.com
The Customer is asked to state the email address used for the order, the purchase reference and the nature of the problem.
Situations that may justify a complaint include:
- A payment debited without the file being delivered.
- A faulty download link.
- A damaged or inaccessible file.
- A delivered photograph that does not match the one ordered.
- A billing error.
- A problem with the conformity of the digital content.
Fraamed examines requests and implements appropriate solutions in accordance with the applicable contractual and legal obligations.
Depending on the circumstances, a new delivery, bringing into conformity, a price reduction or a refund may be offered or required by law.
A simple change of mind after the digital content has been supplied does not automatically entitle the Customer to a refund where the right of withdrawal has been validly lost.
This provision does not in any way limit the Customer’s statutory rights.
Article 11 — Statutory guarantees
The digital photographs sold on Fraamed benefit from the statutory guarantees applicable to digital content.
11.1. Statutory guarantee of conformity
In accordance with Articles L.224-25-12 et seq. of the French Consumer Code, the Seller is required to supply digital content that complies with the contract and the legal conformity criteria.
The Customer benefits from the statutory guarantee of conformity under the conditions laid down by the applicable texts.
For a one-off supply of digital content, the Seller is liable in particular for any lack of conformity existing at the time of supply and appearing within the statutory period of two years.
In the event of a lack of conformity, the Customer may ask for the digital content to be brought into conformity, free of charge, under the conditions and within the time limits laid down by law.
Where bringing it into conformity is impossible, refused, unjustifiably delayed, unsuccessful or in the other cases provided for by the French Consumer Code, the Customer may obtain a price reduction or ask for the contract to be terminated.
These rights are exercised in accordance with the applicable legal provisions.
11.2. Other statutory guarantees
Where the conditions for their application are met, the Customer also benefits from the other statutory guarantees, in particular the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.
No provision of these Terms may have the effect of removing or reducing the mandatory statutory guarantees.
11.3. Contact details
For any request relating to the statutory guarantees:
contact@fraamed.comRedmoot — Fraamed33 avenue de l’Aquitaine64100 Bayonne, FranceArticle 12 — Intellectual property
The photographs sold on Fraamed may be protected by copyright under the French Intellectual Property Code.
Unless otherwise stated, buying a digital photograph does not constitute an assignment of the copyright or other intellectual property rights in that photograph.
The Customer acquires only the rights of use expressly provided for in these Terms.
The photographs, previews, graphic elements, texts and other content of the Site may not be used without authorisation.
Downloading or copying a photograph on the Site outside the features and permissions expressly provided gives its user no additional rights.
Article 13 — Licence to use purchased photographs
Subject to full payment of the price, Fraamed grants the Customer a licence to use the purchased digital photograph under the following conditions.
13.1. Nature of the licence
The licence is:
- Non-exclusive.
- Personal.
- Non-transferable.
- Limited to private, non-commercial use.
- Granted for the legal term of protection of the economic rights concerned, subject to compliance with these Terms and the rights of third parties.
The licence allows the Customer to keep a copy of the purchased photograph and to reproduce it for their personal needs, in compliance with the applicable rights.
13.2. Permitted uses
For personal, non-commercial use, the Customer may in particular:
- Download and save the photograph.
- View it on their personal devices.
- Keep it in their personal archives.
- Have a print made for private use.
- Post it on their personal social media accounts, provided that image rights and other third-party rights are respected.
When the photograph is posted on social media, the credit “Photo: Fraamed” or tagging the official Fraamed account is appreciated, but is not a condition for the licence to be valid.
Posting on social media remains subject to the terms of use of the platforms concerned and must not involve an assignment of rights exceeding those granted to the Customer.
13.3. Uses prohibited without prior permission
Unless specifically authorised in writing, the Customer may not:
- Resell the photograph or offer it for sale.
- Distribute the file to third parties for them to use it.
- Use the photograph for commercial advertising or promotional purposes.
- Include it in a product or service that is sold.
- Grant third parties a licence to use it.
- Present it as a work of which they are the author.
- Remove or alter a rights notice where doing so infringes the rights of its holder.
- Use it in a context that undermines the rights or dignity of the people shown.
Any professional or commercial use requires a prior written agreement setting out the rights granted.
13.4. Respecting image rights
The licence to use a photograph does not constitute general permission to use the image of the people shown.
The Customer remains bound to respect image rights, privacy and other third-party rights.
Any use going beyond the personal scope provided must be assessed in the light of the rights of the people photographed and any permissions required.
Article 14 — Liability
Fraamed undertakes to supply the digital content ordered in accordance with these Terms and the applicable legal provisions.
The Customer is responsible for the accuracy of the information they provide and for using the files in accordance with the licence granted.
The Seller cannot be held liable for damage resulting solely from use of the photographs contrary to these Terms or the regulations, where such damage is not attributable to it.
In the event of a technical incident, Fraamed takes appropriate steps to restore access to the features concerned or to offer a suitable solution for the orders affected.
No clause in these Terms may exclude or limit the Seller’s liability where such a limitation is prohibited by law, nor affect the Customer’s rights under the statutory guarantees.
Article 15 — Catalogue availability
Fraamed may change its catalogue, add new photographs or withdraw certain content from sale.
The presence of a photograph on the Site does not guarantee that it will be available indefinitely.
Fraamed may in particular remove a photograph following a request relating to the rights of a person shown, an intellectual property dispute or any other legal obligation.
Where a photograph becomes unavailable before it is supplied to the Customer although an order has been confirmed, Fraamed informs the Customer and applies the solutions provided for by law, including a refund where appropriate.
The later removal of a photograph from the catalogue does not, in itself, cancel the rights of use already validly granted to the Customer, subject to the rights of third parties and legally applicable decisions.
Article 16 — Personal data protection
Personal data collected when orders are placed is processed under the conditions set out in Fraamed’s Privacy Policy.
The data collected may be used in particular to:
- Process and follow up orders.
- Deliver the digital files.
- Carry out invoicing.
- Respond to requests sent to customer service.
- Comply with legal and accounting obligations.
- Secure payments and prevent fraud.
Payments are processed by Stripe and transactional emails are sent using Brevo.
The Customer may exercise their rights under data protection regulations by contacting: contact@fraamed.com
For more information, the Customer is invited to read the Privacy Policy available on the Site.
Article 17 — Force majeure
Neither party may be held liable for a failure to perform its contractual obligations resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code.
If such an event occurs, performance of the obligations prevented is suspended under the conditions laid down by law.
If the impediment is permanent or justifies termination of the contract under the applicable rules, the consequences of that termination are determined by the legal provisions.
Article 18 — Governing law and disputes
These Terms are governed by French law, subject to any mandatory consumer protection provisions that may apply in the consumer’s country of residence.
In the event of a dispute over the interpretation or performance of these Terms, the Customer is invited to seek an amicable solution by contacting customer service.
Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with the applicable rules of ordinary law.
No provision of these Terms may deprive the consumer of the judicial protection they enjoy under applicable mandatory regulations.
Article 19 — Acceptance of the Terms and Conditions of Sale
The Customer acknowledges having had the opportunity to read these Terms before confirming their order.
They are accepted during the purchasing process, through a positive action by the Customer.
These Terms are available on the Site at any time.
The version applicable to the contract is the one accepted by the Customer when ordering.
