1. Our commitment
Fraamed is a platform dedicated to sports photography, particularly surf photography, allowing athletes to find and buy pictures taken during their sessions.
We pay particular attention to respecting the image rights, privacy and personal data of the people photographed.
Our aim is to showcase the sport while respecting everyone’s rights.
2. Photographs taken in public spaces
The photographs shown on Fraamed are mainly taken during sports sessions, particularly from beaches and areas open to the public.
The fact that a photograph is taken in a public place does not mean that publishing or selling it is automatically permitted.
Where a person is isolated and recognisable in a photograph, their permission may be required before it is published or used commercially.
Exceptions may exist, particularly for informing the public or for freedom of artistic expression, under the conditions laid down by applicable legislation and case law.
Fraamed takes care to take these requirements into account in the conditions under which its photographs are published and sold.
3. Photographs available on Fraamed
The photographs offered on the platform can be viewed as watermarked previews.
Visitors can search for the photographs from their sessions, in particular by the place and date they were taken.
Fraamed does not use any facial recognition or biometric identification system to find the people photographed.
The pictures available for purchase are offered as digital files.
A watermark is a measure to protect the files, but it does not constitute permission to publish under image rights.
4. Image rights of minors
Particular attention is paid to photographs showing minors.
Publishing and selling photographs of identifiable minors requires compliance with the rules on parental responsibility and image rights.
Fraamed takes these obligations into account when reviewing the photographs concerned and the requests made by legal guardians.
Parents or legal guardians may contact Fraamed with any question or request about a photograph showing their child.
5. Requesting the removal of a photograph
Do you appear in a photograph published on Fraamed and wish to request its removal?
You can contact us free of charge at the following address: contact@fraamed.com
To help us process your request, please specify, where possible:
- The link to the photograph concerned or its reference.
- The place and approximate date of the session.
- The reason for your request.
You can also report a photograph showing a minor for whom you are the legal guardian.
We will examine your request as quickly as possible, taking into account the rights of the people concerned and the applicable legal obligations.
Additional verification of the identity or capacity of the requester will only be carried out where justified, particularly in case of reasonable doubt.
If the request concerns the exercise of a right under the GDPR, a response will be given within the statutory period of one month, unless an extension is permitted by the regulations.
Where the request is justified, Fraamed will take appropriate measures, which may include removing the photograph from the publicly available catalogue.
6. Photographs already purchased
When a photograph is removed from the platform, Fraamed may stop displaying and selling it.
However, some photographs may have been bought and downloaded before their removal.
Removing a picture from the Fraamed catalogue does not necessarily make it possible to delete copies already downloaded by third parties.
Any further measures are considered in the light of the applicable rights and the circumstances of each case.
7. Use of photographs by buyers
Buying a photograph on Fraamed does not give the buyer a general right over the image of the people shown.
Purchased photographs are intended for personal, non-commercial use, in accordance with the Terms and Conditions of Sale.
Any use must respect copyright, image rights and the rights of third parties.
In particular, the photographs may not be freely used for advertising or commercial purposes without the necessary permissions.
8. Personal data protection
Where a photograph makes it possible to identify a person directly or indirectly, it may constitute personal data within the meaning of the General Data Protection Regulation (GDPR).
The people concerned have the rights provided for by the regulations, in particular the rights of access, objection and erasure where the legal conditions are met.
These rights can be exercised by contacting: contact@fraamed.com
For more information about how personal data is processed, please see our Privacy Policy.
The people concerned also have the right to lodge a complaint with the French data protection authority, the Commission nationale de l’informatique et des libertés (CNIL).
